Statement by EUD/EUSR spokesperson on legislation relating to Freedom of Access to Information

 

EUD/EUSR spokesperson Andy McGuffie said:

“Access to information is an indispensable instrument in every democratic society, underpinning processes of transparency and accountability in the work of public authorities. We are aware that BiH Law on Freedom of Access to Information is being reviewed with the intention of making amendments.

We expect a truly inclusive and consultative approach to be ensured throughout this process. All parties affected by the implementation of this Law need to be provided with an opportunity to contribute to the drafting process, encouraging a thorough analysis of all viewpoints so the final draft aspires towards the highest standards and best practices, and provides sound answers to challenges posed by the implementation of the current Law.

We underline that the right to privacy as well as personal data protection is a principle upheld and entrenched in the EU acquis. It is therefore important that BiH authorities find appropriate processes to get a satisfactory balance between the right to access information and the right to privacy.”
